Owning a Saratoga Home as a Canadian: The Money Side

Montreal is roughly three hours down the Northway from Saratoga Springs, and plenty of Quebecers make the drive every summer. Some come for the track, some for SPAC, and some simply for August on a porch on Union Avenue. A growing number decide to buy a place of their own.

Owning that house is the easy part. Each one quietly ties a Canadian household to the IRS, New York State and Saratoga County. The Canada Revenue Agency still expects its full share. Good U.S. Canada Financial Planning treats the house as one piece of a two-country picture. Here is how the pieces fit.

Can a Long Saratoga Summer Make You a US Resident?

Immigration and tax count days differently, so it pays to track both. Canadian visitors are generally admitted for up to six months at a time. The IRS uses its own test, and it is the one that catches people.

Cross 31 US days this year and 183 on a weighted three-year count, and the IRS substantial presence test treats you as resident. That total counts every day this year, one third of last year’s days and one sixth of the days from the year before. A snowbird who adds a long Saratoga summer to a Florida winter can cross the line without noticing.

There is a way out for most second-home owners. If you spent fewer than 183 days in the US this year and kept a closer connection to Canada, Form 8840 lets you claim it. It is due by June 15 when you have no other US return to file. Your travel history may also appear on the CBP I-94 website, though land crossings are not always recorded.

What Happens if You Rent It Out for Track Season?

Track season turns plenty of Saratoga homes into short-term rentals, and the summer meet runs from July into early September. Renting is where a quiet second home becomes a US tax filing. The default rule for a non-resident is blunt.

  1. Default withholding. The tenant or property manager withholds 30% of gross rent for the IRS, with no deduction for expenses.
  2. Net election. You can instead elect to be taxed on net rental income, after property tax, insurance, repairs and depreciation, by filing a Form 1040-NR each year.
  3. Canadian reporting. Canada taxes residents on worldwide income, so the same rent goes on your Canadian return. A foreign tax credit for US tax paid usually prevents double tax.
  4. Foreign property form. A home used mainly for personal enjoyment is excluded from Canada’s T1135 reporting. A home held mainly to earn rent can count toward the CAD $100,000 cost threshold that triggers the form.

The net election is usually the better deal, since expenses often wipe out most of the taxable rent.

What Changes When You Sell the House?

A sale by a foreign owner brings in FIRPTA, the Foreign Investment in Real Property Tax Act. FIRPTA is a federal rule that makes the buyer collect tax for the IRS at closing. The standard rate is 15% of the gross sale price, not of the gain.

Most sellers owe far less than that. Filing Form 8288-B before closing can reduce the withholding to the tax actually expected. Either way, you file a US return for the year of sale to settle up. Canada then taxes the gain as well and credits the US tax against it.

Local prices make this real money. Saratoga property values have climbed, as deals like Gaffney’s selling for $3.5 million show on the commercial side. Assessed values and tax bills for each parcel appear on the Saratoga County assessment rolls. Those bills arrive whether or not you are resident, and New York’s STAR school tax relief applies only to a primary residence.

Could the House Trigger US Estate Tax?

Canadian owners rarely ask this, yet the answer depends on the size of the whole estate, not just the house.

  • The trigger. A non-resident whose US assets, including real estate and US shares, exceed $60,000 at death has a US estate tax filing duty.
  • The treaty credit. The Canada-US tax treaty gives Canadians a share of the US exemption, prorated by the portion of their worldwide estate held in the US.
  • The 2026 figure. The full federal exemption is $15 million for 2026, so most Canadian estates below that size owe no federal estate tax after the treaty credit.
  • New York’s own tax. The state can tax New York real estate owned by people who live elsewhere. Its 2026 exclusion is $7,350,000, and it disappears entirely above 105% of that amount.
  • Canada at death. Canada treats the house as sold at fair market value at death. The treaty allows a credit for US estate tax against that Canadian tax.

Even when no tax is owed, the estate usually files Form 706-NA to claim the treaty benefit.

A Season Plan for Canadian Owners

The best Saratoga summers are the ones where the paperwork happened in spring. A few habits keep the house a pleasure rather than a filing headache.

  1. Keep one day log for every US trip, Florida included, backed by receipts and toll records.
  2. Decide before track season whether you will rent, and arrange the net election in writing with your manager.
  3. Review how the house is titled, since that shapes both US estate exposure and Canadian tax at death.
  4. Keep purchase records and renovation receipts, which matter on both returns when you sell.

Like the owners of a Saratoga County home built around how they actually live, Canadian buyers do best with a plan built around both countries.

Frequently Asked Questions

Do Canadians Pay US Tax On a Saratoga Vacation Home?

Not simply for owning it, beyond local property tax. US income tax applies if you rent it out or sell it, and US estate tax can apply at death. Spending too many days in the US can also make you a US tax resident.

Who Files the Closer Connection Form?

Form 8840 is the closer connection exception statement. Canadians who pass the substantial presence test but spent fewer than 183 days in the US this year file it to stay non-resident for US tax. It is due by June 15 when no other US return is required.

How Much Is Withheld When a Canadian Sells a US Home?

The buyer generally withholds 15% of the gross sale price under FIRPTA. A withholding certificate on Form 8288-B can reduce that to the expected tax. Any excess comes back after you file a US return.

Can Renting During Track Season Change My Canadian Taxes?

Yes. The rent is reportable in Canada, with a credit for US tax paid. A home held mainly to earn rent may also need T1135 foreign property reporting if its cost tops CAD $100,000.
